In accordance with Article 63(2) of Regulation (EU, EURATOM) 2018/1046 of 18 July (Omnibus Regulation), which repealed Regulation (EU/EURATOM) No 966/2012, Member States shall take all necessary measures, including legislative, regulatory and administrative measures, to protect the financial interests of the EU, including the prevention, detection and correction of irregularities and fraud.

In addition to Article 28(h) of Regulation (EU) No 223/2014 of the European Parliament and of the Council of 11 March 2014, management and control systems for programmes must ensure the prevention, detection and correction of irregularities, including fraud, and the recovery of amounts unduly paid, Article 32(4)(c) of that Regulation requires the Managing Authority to establish effective and proportionate anti-fraud measures, taking into account the risks identified.

The MA’s anti-fraud strategy of the OP APMC aims to ensure the adoption of effective and proportionate anti-fraud measures, taking into account the risks identified in the scope of its activity and establishes its position in relation to fraud, as well as the procedures to be followed in relation to this topic, in the areas of fraud prevention, detection and correction.

In this context, the definition and implementation of a system for the submission and handling of complaints is one of the obligations of the APMC OP under its Anti-Fraud Strategy, which provides for the existence of an area for electronic complaints, where the general public can reasonably report suspicions of fraud and other irregularities of which they are aware in the application of Community funds.

All complaints submitted by this means are treated with complete confidentiality.

The whistleblower will receive a notice of initiation of enquiries and will subsequently be informed of the findings.

The Managing Authority of the Operational Programme Demography, Qualifications and Inclusion, designated as PEOPLE2030, headquartered at Av. Columbano Bordalo Pinheiro No 86, 1070-065, Lisbon, as a Mission Structure established by Council of Ministers Resolution No 14/2023 of 10 February 2023, assumes the competences, rights and obligations of the Management Authority of POISE/POAPMC/POCH, as laid down in Order No 6927-A/2023 of 28 June 2023, until the date of the declaration of closure of the Programme issued by the respective audit authority.
